A contract of employment is an agreement regarding the conditions of employment between an employer and an employee (but not an independent contractor). The agreement can be made orally or signed in writing. The agreement will have both written terms, as well as implied terms and terms incorporated or applicable as a result of statutory protection under the Employment Ordinance.
